Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Nomi ("Nomi", "we", "us") for your use of the Nomi application and related services (the "App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App. This is also the End User License Agreement (EULA) for the App.

1. License

We grant you a personal, limited, non exclusive, non transferable, revocable license to use the App on Apple branded devices that you own or control, as permitted by the App Store Usage Rules. You may not copy, modify, reverse engineer, sell, or distribute the App, except as allowed by law.

2. Subscriptions and billing

Full access to Nomi requires an auto renewing subscription, offered as a monthly plan and a yearly plan. Pricing is shown in the App before you purchase and may vary by region.

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription renews automatically at the same price unless you cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your App Store account settings. Cancellation takes effect at the end of the current paid period.
• Purchases and renewals are handled by Apple. Refunds are subject to Apple's policies. We do not process refunds directly.

3. Acceptable use

You agree to use the App only for lawful, personal, non commercial purposes. You will not misuse the App, attempt to disrupt it, upload unlawful content, or use it to violate the rights of others.

4. Not medical advice

Nomi is a wellness and food journaling tool. It does not provide medical, diagnostic, or professional nutritional advice, and its scores and nutrient values are estimates generated from photos. Do not rely on the App for medical decisions. Always consult a qualified healthcare professional regarding your health, diet, allergies, or any medical condition. If you have a medical emergency, call your local emergency number.

5. User content and accounts

You are responsible for the content you add and for keeping your account secure. You retain ownership of your content. You grant us the limited rights needed to operate the App, such as processing a meal photo to generate your analysis.

6. Intellectual property

The App, including its design, text, graphics, and the Nomi name and mascot, is owned by us and protected by law. These Terms do not transfer any of our intellectual property to you.

7. Third party services

The App relies on third party services, including providers for analysis, authentication, and subscription management. Your use of those features may also be subject to the third party's terms. We are not responsible for third party services.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non infringement. We do not warrant that the App will be uninterrupted, error free, or that any estimate it produces is accurate.

9. Limitation of liability

To the maximum extent permitted by law, Nomi will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the App. Our total liability for any claim will not exceed the amount you paid for the App in the twelve months before the claim.

10. Termination

You may stop using the App at any time and delete your account from within the App. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination will survive.

11. Changes

We may update these Terms from time to time. When we do, we will revise the date above. Continued use of the App after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws applicable at our place of business, without regard to conflict of laws rules. Nothing here removes any mandatory consumer rights you have under your local law.

13. Apple App Store terms

These Terms are between you and Nomi only, and not with Apple. Apple is not responsible for the App or its content. The following applies because the App is licensed through the Apple App Store:

• The license granted is a non transferable license to use the App on any Apple branded device you own or control, as permitted by the App Store Usage Rules.
• Apple has no obligation to provide maintenance or support for the App. Any support questions should be directed to us at the contact below.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• Nomi, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet a legal requirement, and claims under consumer protection or privacy law.
• Nomi, not Apple, is responsible for investigating and resolving any third party claim that the App infringes intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated as a terrorist supporting country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you.
